Insurance Litigation in the UAE
Federal Law No. 6 of 2007 of the UAE regulates all the policies, operations and services related to insurance.
As per law in the UAE, all issues related to insurance are first referred to the Committee for Settlement and Resolution of Insurance Disputes.
This is the first step in resolving a dispute related to insurance. Any dispute related to insurance cannot be taken directly to court.
The Committee settles disputes related to insurance through reconciliation.
However, the Committee is not obliged to follow the Civil Procedural Law of the UAE.
The Committee can review relevant documents and related evidence and even has the right to consult experts.
The issue has to be resolved within fifteen days but can be extended.
The dispute is resolved if the involved parties reach a settlement, otherwise, the Committee issues a decision on the dispute.
If the decision is not acceptable by either party, the decision can be challenged in the court of first instance within thirty days after the decision of the Committee.
